REFUND POLICY

We at Flutterby Labs Private Limited ("Flutterby", "we", "us" or "our"), thank you for your purchase at our learning platform "Elnior" (offered through Elnior application on the Google Play Store and Apple App Store).

Elnior is an AI-powered, learner-first microlearning platform created and operated by Flutterby, which curates and personalizes trusted knowledge into short, engaging learning experiences ("Platform"). The products comprising of applications (Apps) offered by us on our Platform shall be referred to as "Products".

This refund policy ("Policy") details when you may be entitled to receive a refund, and how to request one. It applies to purchases completed by consumers through our Platform, in countries where the Platform is available.

If local consumer protection laws provide you with additional or non-waivable rights, the highest level of rights will always apply. Nothing in this Policy limits your mandatory consumer rights. For the purposes of this Policy — "Supplier" means Flutterby, being the creator, operator and supplier of the Platform and the Products; "Subscription" means a purchase of recurring access to the Platform, a Product or the Services for a defined billing period (such as monthly or annual) which renews automatically until cancelled; "purchase" means any completed payment transaction for a Product, Subscription or Service made through or in connection with the Platform, whether one-off or recurring; and "Services" means the Platform together with any related digital content, features, add-ons, upgrades and support made available by Flutterby.

For purchases made through Apple App Store, refund requests must be submitted directly to Apple at https://support.apple.com, and Apple's refund policies will apply. For purchases made through Google Play Store, refund requests must be submitted directly to Google at play.google.com, and Google's refund policies will apply.

This Policy forms part of our Terms and Conditions available at https://flutterby.co/terms-of-service, and is subject to the terms and definitions contained therein. If there is any inconsistency, our Terms and Conditions will apply.

For purchases made outside India (United States, Canada, United Kingdom, Netherlands, United Arab Emirates, Singapore and Australia, together "Other Countries", for more details refer to our FAQs), but barring those related to Apple App Store Purchases in Section 4B below, all purchases made through the Platform in these countries are processed by Paddle.com Market Ltd and its affiliates ("Paddle", paddle.com), our authorized reseller and Merchant of Record. Paddle is the legal seller of the Products in these countries and handles all payment processing, invoicing, tax compliance, order-related customer service and refunds on our behalf. Charges will appear on your payment statement as "PADDLE.NET". Purchases processed by Paddle are also subject to the Paddle Checkout Buyer Terms and Conditions & the Paddle Refund Policy, available at paddle.com/legal, and buyer support is available at paddle.net.

For purchases made in India, all purchases made through the Platform in India are processed by Google LLC ("Google", at play.google.com), engaged by us to collect payments and process refunds. Hence, for purchases in India, Flutterby is the seller of content provider, and Google acts solely as the payment processing facility. Refunds approved by Google are governed by its refund policy available at Google Play's Refund Policy.

1. Global Refund Policy

1.1. Unless required by applicable law, all purchases are non-refundable and non-exchangeable.

1.2. We (through Paddle for purchases in Other Countries, barring those related to Apple App Store Purchases in Section 4B below) may issue refunds on a discretionary basis (see section 7 below) or if you exercise an applicable statutory withdrawal or refund right (see section 2 below).

1.3. With regard to (a) Apple App Store purchases, Apple's refund policy and decision-making process apply, and we do not independently approve or process such refunds. If you make any purchase through the Apple App Store, payment is processed by Apple through your Apple ID account. Apple is responsible for payment processing, billing, cancellations, renewals, and refund handling for those purchases. We do not process refunds for Apple App Store purchases, and any refund request must be submitted directly to Apple at https://support.apple.com; and (b) Google Play Store purchases, Google's refund policy and decision-making process apply, and we do not independently approve or process such refunds. If you make any purchase through the Google Play Store, payment is processed by Google through your Google account. Google is responsible for payment processing, billing, cancellations, renewals, and refund handling for those purchases. We do not process refunds for Google Play Store purchases, and any refund request must be submitted directly to Google at play.google.com.

1.4. Refunds will not be issued where: there is evidence of fraud, refund abuse, or other manipulative behaviour, the account has been suspended for Terms and Conditions violations, and/or the purchase was made more than 14 (fourteen) days ago. Please note (a) Apple App Store purchases are governed separately by Apple's refund policies and are not subject to our discretionary refund approval process; and (b) Google Play Store purchases are governed separately by Google's refund policies and are not subject to our discretionary refund approval process.

1.5. This Policy does not affect consumer rights in relation to any of our Products which are not as described, faulty or not fit for purpose (see section 4 below).

1.6. Refund requests must be made within the applicable statutory or discretionary period described below.

1.7. If you receive a refund in accordance with this Policy, access to the relevant Product will cease.

2. Country-Specific Rules

2.1. Where local consumer protection laws grant unconditional "withdrawal" rights, those rights apply and override this Policy. Where regional differences apply, we apply the highest standard of protection across the relevant country, which is reflected below.

European Union / United Kingdom

2.2.1. Consumers have a 14-day statutory right to withdraw from some digital content and service contracts and receive a full refund.

2.2.2. The right to withdraw applies to one-off purchases and to the first payment under a Subscription contract. It does not apply to subsequent Subscription payments, except in the circumstances described in section 2.2.3 below. If a Subscription includes a free trial period, then, as soon as that free trial period ends, you will again have a period of 14 calendar days to exercise your right to withdraw.

2.2.3. If you completed a purchase in the United Kingdom and have an annual Subscription, you will have a new period of 14 calendar days to exercise your right to withdraw starting on the day the Subscription auto-renews for another year.

2.2.4. The right to withdraw does not apply to the supply of digital content Products that have started to be downloaded, streamed or otherwise used, when you have given express consent to waive your withdrawal rights.

2.2.5. To exercise this right, you must request a refund within 14 days from the date of the purchase (see section 3 below).

Canada

2.3.1. Consumers have a 7-day unconditional right to cancel digital content or service contracts after delivery and receive a full refund.

2.3.2. To exercise this right, you must request a refund within 7 days from the date of the purchase (see section 3 below).

2.3.3. You acknowledge having received access to a French version of this Policy. Vous reconnaissez avoir reçu une version française de cette politique et avoir demandé.

Singapore

2.4.1. Consumers have a 5-day unconditional right to cancel digital content or services after delivery or first access and receive a full refund.

2.4.2. To exercise this right, you must request a refund within 5 days from the date of the purchase (see section 3 below).

India

2.5.1. Consumers may be entitled to remedies under applicable consumer protection laws, including the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, and any amendments thereto, in cases where Products are defective, deficient in service, not as described, or otherwise not fit for purpose.

2.5.2. Refunds for digital Products that are delivered and accessible immediately may not be available once access has been provided, except where required under applicable law or in cases of proven defect, misrepresentation, or unfair trade practice.

2.5.3. Consumers may file complaints with the appropriate consumer forums or authorities, including under the National Consumer Helpline, if disputes are not resolved.

United States

2.6.1. Refund eligibility is governed primarily by this Policy and applicable state consumer protection laws, including laws relating to unfair or deceptive acts or practices.

2.6.2. Consumers may be entitled to remedies, including refunds, in cases of defective, non-conforming, or misrepresented Products.

Australia

2.7.1. Consumers are entitled to non-excludable guarantees under the Australian Consumer Law (ACL), including that Products will be of acceptable quality, fit for purpose, and match their description.

2.7.2. If a Product fails to meet a consumer guarantee, consumers may be entitled to a repair, replacement, or refund, depending on whether the failure is major or minor.

United Arab Emirates

2.8.1. Consumers may have rights under applicable UAE consumer protection laws, including Federal Decree-Law No. 15 of 2020 on Consumer Protection and its implementing regulations. Refunds may be available where Products are defective, not as described, or fail to meet agreed specifications.

2.8.4. Suppliers of any products and services are required to ensure clear disclosure of pricing, features, and terms prior to purchase, and failure to do so may give rise to consumer remedies.

3. How to Withdraw and Request a Refund

3.1. For purchases made in Other Countries, barring those related to Apple App Store Purchases in Section 4B below, approved refunds are processed by Paddle and typically appear within 5–10 (five to ten) business days depending on your payment method. With regard to (a) Apple App Store purchases, refund requests must be submitted directly through Apple at https://support.apple.com, and (b) Google Play Store purchases, refund requests must be submitted directly through Google at play.google.com. To withdraw, cancel and/or request a refund for other purchases, contact us using one of the following methods:

  • Use the "View receipt" or "Manage subscription" link in your purchase confirmation email;
  • Submit a request via the support link provided in your receipt or within your account's billing page; or
  • Visit our support page and select the "Request refund" option.

3.2. If eligible, refunds will be processed using the same payment method where possible and within 14 days of approval of the request.

3.3. Paddle purchase records, if applicable, will be used to verify eligibility and timing but will not override your statutory rights.

3.4. If you are not sure of the details of your purchase or whether you are eligible for a refund, please contact us at support@flutterby.co and we will do our best to help.

3.5. If a purchase is not eligible for a refund, you may still cancel the Subscription at any time to prevent future billing. The cancellation will take effect at the end of the billing period of your subscription, and will prevent any further payments from being taken.

4A. Refunds for Technical or Product Defects

If you experience persistent technical issues with the Product you purchased using the Platform or a material defect that prevents you from accessing the features or benefits as described, please:

  • Contact us at support@flutterby.co first to attempt to resolve the issue or request a refund;
  • If the issue cannot be resolved, for purchases made in Other Countries, barring those related to Apple App Store Purchases in Section 4B below, contact Paddle's support team (see section 3 above) and provide details of the issue and any response received from us, as indicated above;
  • Where there is evidence of a material technical or Product defect, Paddle/we (as applicable) will issue a refund in accordance with applicable consumer protection laws.

4B. Apple App Store Purchases

By making an in-app purchase on our Platform through the Apple App Store or by subscribing to any of our offerings on the Platform through the Apple App Store (such purchase, an "App Store Purchase"), you agree to the following:

  • Payment. All payments related to an App Store Purchase are processed by Apple through your Apple ID account. Your selected payment method will be charged upon confirmation of purchase.
  • Subscriptions. Monthly and yearly subscriptions subscribed by way of an App Store Purchase automatically renew at the end of each billing period unless auto-renew is turned off at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • Managing Subscriptions. You may manage, change, or cancel your subscription subscribed by way of an App Store Purchase at any time through your Apple ID Account Settings. Cancelling a subscription subscribed by way of an App Store Purchase prevents future renewals but does not provide a refund for the current subscription period.
  • One-Time Purchases. Video packs and other one-time digital purchases made by way of an App Store Purchase are made available immediately after successful payment and remain associated with your account, subject to our Terms and Conditions.
  • Refunds. All billing, cancellations, and refund requests related to an App Store Purchase are governed by Apple's payment policies. We do not process refunds for purchases made through the Apple App Store; refund requests related to an App Store Purchase must be submitted directly to Apple.
  • Price Changes. We may change the pricing of subscriptions or digital content from time to time. Any changes to subscription pricing for subscriptions through App Store Purchase will be communicated and applied by Apple in accordance with its policies and will only affect future billing cycles.

4C. Google Play Store Purchases

By making an in-app purchase on our Platform through the Google Play Store or by subscribing to any of our offerings on the Platform through the Google Play Store (such purchase, a "Play Store Purchase"), you agree to the following:

  • Payment. Payments for Play Store Purchases are processed through your Google Account and the payment method linked to your Google account (or other payment methods made available by Google). You are responsible for all amounts payable in connection with purchases made through your Google Account.
  • Purchase Contract. When you purchase our content on Google Play Store, you enter into a separate sale contract with Google LLC. The contract is completed when Google sends you an email confirming your purchase.
  • Subscriptions. Subscriptions purchased through Google Play Store automatically renew each billing period and may be charged up to 48 hours before the start of the next period. You may cancel at any time before the end of the billing period; cancellation stops future renewals but does not entitle you to a refund for the current period, except where required by law or Google Play's Refund Policy (for example, for defective content).
  • Refunds. Refunds for Play Store Purchases are governed by Google Play's Refund Policy and applicable law. Except as expressly permitted under that policy or required by law, all sales are final and no returns, replacements or refunds are available. If a refund is granted, the transaction may be reversed and you may lose access to the relevant Product. Refund requests must be submitted directly through Google Play Store at play.google.com.
  • Defective or Unavailable Content. You should check the Product as soon as reasonably possible after it becomes available and notify Google promptly of any errors or defects. If Google removes or ceases to provide access to purchased content (for example, due to loss of rights, discontinuation, or critical security issues), Google may offer replacement content or a full or partial refund where applicable.
  • Price Changes. Prices and availability of content on Google Play Store may change before purchase. For subscriptions, Google will notify you of price increases; the increase applies to the next payment after notice, and you may cancel before the end of the current billing period to avoid the higher charge.

5. Add-Ons and One-Time Purchases

5.1. Add-ons linked to a main Subscription expire when the main Subscription ends, unless otherwise stated.

5.2. Refund eligibility for add-ons and one-time purchases follows the same criteria as the main purchase, unless local law provides otherwise.

5.3. Items that are delivered and fully accessible immediately may be non-refundable once delivered, except where required by law.

6. Chargebacks and Payment Disputes

6.1. Subject to Section 3 above, for purchases made in Other Countries (barring those related to Apple App Store Purchases in Section 4B above), we encourage you to be in contact through Paddle (as specified in Section 3 above), prior to raising a request for a chargeback or raising a dispute with your bank, card issuer or other payment provider.

6.2. If you initiate a chargeback or payment reversal, access to the relevant Product may be temporarily suspended while the matter is reviewed.

6.3. On receipt of the chargeback or dispute, we will provide the payment provider with payment details and, where relevant, your consent to waive statutory rights.

6.4. This does not affect your lawful rights to dispute a charge under card-scheme or consumer-protection rules.

7. Discretionary Refunds

7.1. Subject to Section 3 above, we may, at our sole discretion, issue a refund if a request is submitted within 14 days of your purchase date. Submission of a request within this 14-day period does not guarantee a refund.

7.2. All refund requests are reviewed on a case-by-case basis. We may consider relevant factors including the nature of the Product, the reason for the request, usage or consumption, and any applicable contractual terms. We may approve a refund in full, approve a partial refund, or decline the request.

7.3. Any discretionary refund granted by us is voluntary and does not create an obligation to provide refunds in the future, including for similar requests. Our decision to issue (or not issue) a refund does not waive any rights or remedies we may have under applicable agreements or law.

8. Updates to this Policy

8.1. We may update this Policy from time to time.

8.2. The version in effect at the time of your purchase governs that purchase. We recommend saving or printing a copy for your records.

9. Governing Law and Resolving Disputes

This Policy is subject to the governing law, complaints and disputes provisions set out in our Terms and Conditions.
